These Terms and Conditions of Website Use, our Cellper®Elite Terms and Conditions of Sale and our Privacy and Cookies Policy (together known as the Terms and Conditions), govern your use of CellsUnited websites (www.cellsunited.com and www.cellperelite.com) and your relationship with CellsUnited (CellsUnited, seller, we or us).
Please read these carefully as they affect your rights and liabilities under the law. If you do not agree with any of these Terms and Conditions, please do not use our websites and the online shop or attempt to purchase products from us by any means.
These Terms and Conditions do not affect your statutory rights.

Although we will do our best to provide constant, uninterrupted access to the websites, we do not guarantee this. We accept no responsibility or liability for any interruption or delay.
CellsUnited does not warrant that functions contained in the website’s content will be uninterrupted or error free, that defects will be corrected, or that the websites or the server that makes them available are free of viruses or bugs. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties.

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to our websites.
The presentation of material on this website and the geographical designations employed do not imply the expression of any opinion whatsoever on the part of CellsUnited concerning the legal status of any country, territory or area, or concerning the delimitation of its frontiers or boundaries. These terms shall be governed by and interpreted in accordance with the laws of England.
CellsUnited makes no promise that materials on our websites are appropriate or available for use in locations outside the United Kingdom, and accessing our sites from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so at your own initiative and are fully responsible for compliance with all local laws and regulations.
If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected if the contract is capable of continuing in existence without the invalid, illegal or unenforceable term(s). This contract shall be governed by and interpreted in accordance with English law.
Cellper®Elite Terms and Conditions of Sale
To register as a buyer of Cellper®Elite you must be over eighteen years of age and hold a current bank account. By agreeing to order products on this site the buyer agrees to buy at the price and in the way described on the site. The seller’s acceptance of the order is conditional on receipt of payment, the ability of the seller to provide the product or service and there being no error or innocent misrepresentation by either party.
If the item you have ordered is out of stock we will let you know as soon as possible by email or phone and give you the option to cancel.
If for any reason the product/service cannot be provided within 30 days any payment will be fully refunded. All refunds are given at the discretion of the company management.
The buyer accepts responsibility for judging the suitability of the product for the buyer’s intended purpose.
The products, any advice, and the presentation of the products have been prepared in accordance with English Law, but the seller does not claim that they necessarily accord with the laws of other countries.
To the extent permitted by law the seller excludes any warranties in relation to the product, specifically to efficacy or taste. However the buyer’s statutory rights are not affected.
Our products are supplied bottled, labelled, with a tamper-evident strip and in a card outer. The products should be kept cool and used only as directed. If, on initial opening, you can see any of the tamper-evident strips are damaged or broken, you must reseal the box and inform us immediately of the nature and extent of the damage and within 24 hours. We cannot take responsibility for any evidence of tampering after you have opened, removed and handled the product.
Orders for home delivery are despatched by mail or courier. The packaging is designed and tested to ensure that the goods are delivered in good condition. Full details of delivery arrangements are shown elsewhere on this website and may change from time-to-time. We have made every effort in the design of product and packaging to make it deliverable through a standard letterbox, as defined by The Royal Mail. If your letterbox is smaller than standard, please ensure that there will be someone to receive the parcel at the delivery address. We cannot guarantee the condition of your purchase if we are unable to deliver the product. We will always request that a parcel is ‘left safe’ if there is nobody in to sign for the goods. However, this cannot be guaranteed and is at the discretion of the driver whether he/she feels it is safe to do so. If you are not at home it may not be possible to leave it, or to attempt delivery until the next working day. If you have particular delivery instructions or would not like you order to be left without a signature, please advise at the time of ordering. It is also possible to send goods to a neighbour. Please note it is not possible to give multiple alternatives for the delivery address.
We cannot accept responsibility for addresses provided incorrectly or without a full postcode.
Any sale or service is subject to English law and the sole jurisdiction of the English courts.
All time-sensitive promotions posted on our websites are according to GMT timing only.
A promotional code is redeemed by entering the code as required in the online purchase process.
Your use of a promotional code indicates your agreement to be bound by the promotional code Terms and Conditions.
Promotional codes cannot be used in conjunction with each other or any other offer/discount listed on a CellsUnited website.
All promotion codes are limited to one per customer unless otherwise stated. Any further terms and conditions specified must be observed in full and we reserve the right to withdraw or cancel a promotional code for any reason at any time.
Additional charges such as delivery or postage & packing are not discounted unless specified in writing.
Whilst every effort will be made to meet customer demands, cancellations or variations may be necessary as a result of an Act of God, war, strike, lockout, labour dispute, fire, flood, drought, severe weather or other causes beyond the control of CellsUnited Ltd, its subsidiaries and suppliers.

If you breach any of these Terms and Conditions and CellsUnited ignores this, we will still be entitled to use our rights and remedies at a later date or in any other situation in which you breach our Terms and Conditions.
We will not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our control and any person not party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exist or are available apart from that Act.
